Postcrest Terms of Service

Thank you for using Postcrest (the "Services"). These Terms of Service (the "Agreement") outline your rights regarding the content you may generate or post using the Service, including but not limited to images, videos, text, or speech ("User Content"), as well as your usage of the Services. This Agreement also addresses other important topics, including limitation of liability and dispute resolution. We encourage you to read this Agreement carefully. For information on how we handle your data, please refer to our Privacy Policy.
1. Acceptance of Terms
By utilizing the services provided by Postcrest ("Services"), you are agreeing to comply with and be bound by the following terms and conditions ("Terms of Service").
2. Subscription Plans and Billing
2.1 Subscription Options
Postcrest offers various subscription plans. Payments for these subscriptions are processed through Stripe and are available on both a monthly and annual basis.
2.2 Downgrades, Cancellations, and Upgrades
You are not permitted to downgrade your subscription before the completion of the current billing cycle. However, you may upgrade your subscription plan at any time. If you choose to cancel your subscription, your cancellation will take effect at the end of the current billing cycle, allowing you to continue using the Services until then. For cancellations or to edit your subscription, simply navigate to the "Edit Subscription" section in the billing tabs on the organization settings page, or contact us via email at [email protected].
2.3 Trials
Postcrest may offer a trial that starts a subscription for a small one-time fee, stated on the checkout page. The fee is charged as a card check and is non-refundable once the trial has started. The credit allowance and the duration of the trial are shown at checkout.
When the trial ends, your subscription automatically continues into the plan you selected at checkout, at the price shown there, unless you cancel before the trial ends. You can cancel at any time from Settings > Billing. A canceled trial keeps running until its end date, and no further charges are made.
By starting a trial you ask us to begin providing the Services immediately and you acknowledge that the trial fee is due at that moment. Trials are limited to one per person. Abuse of the trial, including duplicate accounts or chargebacks of the trial fee, may lead to termination of your account.
3. Service Availability
Postcrest strives to ensure uninterrupted service availability. However, we cannot guarantee the absence of interruptions, including but not limited to scheduled or unscheduled maintenance, and will not be liable for any damages or losses incurred due to such interruptions.
4. User Content and Social Media Posting
4.1 User-Generated Content
You retain all rights to, and are solely responsible for, the content you post or generate through the Service. This includes, but is not limited to, text, images, videos, and audio.
4.2 Permission to Post on Your Behalf
By using the Service, you grant Postcrest permission to post content on your connected social media accounts on your behalf. We will only post content that you have created or have explicitly consented to be posted.
5. Disclaimer of Warranties
The Services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement.
Postcrest does not guarantee that the Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis.
6. Limitation of Liability
Under no circumstances shall Postcrest be liable for any direct, indirect, incidental, consequential, or exemplary damages (including, but not limited to, loss of data or loss of profits) arising from the use of or inability to use the Services, even if Postcrest has been advised of the possibility of such damages.
7. User Conduct and Responsibilities
You are solely responsible for your conduct while using the Services. You agree to abide by all applicable local, state, national, and international laws and regulations. If you infringe upon the intellectual property rights of others, and such infringement results in liability for Postcrest, you will be held accountable for all costs and damages incurred.
8. Intellectual Property Rights
8.1 Your inputs and generated outputs
You keep all rights in the prompts, images, audio and other material you upload ("inputs"). You grant Postcrest a licence to process your inputs only to provide the Services. You are responsible for having the rights to use your inputs, including any person's likeness or voice.
As between you and Postcrest, you own the images, videos, audio and text the Services generate for you ("outputs"), and Postcrest grants you a worldwide, royalty-free, perpetual licence to use them for any lawful purpose, including commercial use, on every plan and during a trial, with no attribution required. Outputs are AI-generated: similar outputs may be generated for other users, and the extent to which AI-generated material is protected by copyright varies by country.
Posts scheduled and published through Postcrest from a plan below Premium carry a small Postcrest watermark; downloads never do.
8.2 Restrictions
You may not use the Services for:
- Competitive research or reverse engineering.
- Using automated methods to interact with or scrape our Services (e.g., bots, data mining, or any other type of automated data gathering or extraction methods).
9. Termination of Access
Postcrest reserves the right to suspend or terminate your account at any time, for any reason, without notification. No refunds will be issued for any unused service periods upon termination.
10. Service Modifications
Postcrest reserves the right to modify or discontinue the Services at any time, including changes to algorithms, features, and the art style of assets. We will not be liable for any damages due to such changes.
11. Prohibited Uses
You may not use the Services for any unlawful, harmful, unethical, or inappropriate activities. This specifically includes, but is not limited to, the creation or distribution of content that is:
- Discriminatory or harassing.
- Violent or promoting violence.
- Sexually explicit, hateful, or otherwise objectionable.
12. Governing Law
These Terms of Service shall be governed by the laws of The Netherlands, without respect to its conflict of laws principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Amsterdam, The Netherlands.
13. Refund Policy
13.1 No Refund After Any Use
As soon as the Services have been used in any way during a billing cycle (monthly or annual), the full charge for that billing cycle is non-refundable, however many credits remain unused. Use includes, for example, using a single credit, generating, editing or uploading content, creating or training a character, connecting a social media account, or scheduling or publishing a post. Charges for earlier billing cycles are never refundable, whether or not the Services were used in them.
13.2 Possible Refunds Without Any Use
If you have not used the Services in any way in the current billing cycle, a refund of that cycle's charge may be considered at Postcrest's sole discretion.
13.3 No Partial or Prorated Refunds
By subscribing, you acknowledge that Postcrest does not provide partial or prorated refunds, whether for unused credits, for the remainder of a subscription period, or when you cancel during a billing cycle.
13.4 Right of Withdrawal (EU Consumers)
If you are a consumer in the European Union, you normally have the right to withdraw from a distance contract within 14 days. Postcrest is a digital service that starts as soon as you subscribe or start a trial. At checkout you expressly ask us to start the service immediately and acknowledge that, once the service has started, you lose your right of withdrawal (Directive 2011/83/EU, Article 16, as implemented in the Dutch Civil Code). The trial fee and any subscription charge are therefore governed by sections 13.1 to 13.3 above.
You can cancel your subscription or trial at any time from Settings > Billing; it then runs until the end of the current period and is not renewed.
14. Changes to These Terms
We reserve the right to update or modify these Terms of Service at any time. When we do, we will:
- Update the "Effective Date" at the top of this page.
- In some cases, provide additional notice (such as by email or an in-service notification).
Your continued use of the Services following such modifications indicates your acceptance of the revised Terms.
15. Indemnification
You agree to indemnify and hold harmless Postcrest, its affiliates, officers, employees, and agents from and against any and all claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Services.
- Any User Content you generate.
- Your violation of these Terms.
16. Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision shall be modified to the extent necessary to make it valid and enforceable, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, along with our Privacy Policy and any additional agreements referenced herein, constitute the entire agreement between you and Postcrest regarding the Services. They supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and Postcrest.
